Evaluation of Whether the Air Force Improperly Denied Solicitation Packages to Chem-Fab Corporation

Pursuant to congressional requests, GAO determined whether an Air Force activity violated defense acquisition regulations and federal law by denying solicitation packages to a small business contractor.

GAO found that the Air Force would ordinarily have sent solicitation packages to the firm upon request, but did not in eight instances because of staff shortages and an unusually large volume of requests for such packages. In addition, GAO found that the Air Force did not violate the law because it was not aware of the firm's small business status at the time the firm requested the packages. GAO noted that: (1) the Air Force has made changes to avoid such problems in the future; and (2) the affected firm has since been added to the bidders list maintained by the Air Force and has been awarded contracts by the Air Force activity.
