Interim Rules for Mental Health Parity Gao ID: OGC-98-22 January 15, 1998

Pursuant to legislative requirement, GAO reviewed the Internal Revenue Service, Pension and Welfare Benefits Administration, and Health Care Financing Administration's new rules for mental health parity. GAO noted that the: (1) new rules would govern the parity between medical/surgical benefits and mental health benefits in group health plans and health insurance coverage offered by issuers in connection with a group health plan; and (2) agencies generally complied with applicable requirements in promulgating the rules, although it appears that the agencies could have obtained comments earlier and issued the interim rules in time to permit the Small Business Regulatory Enforcement Fairness Act of 1996's 60-day delay period for congressional review.
