Information on Leave-Without-Pay at the Department of Justice Gao ID: GGD-88-129FS September 12, 1988

Pursuant to a congressional request, GAO provided information regarding the Department of Justice's policies governing the granting of leave without pay (LWOP).

GAO found that: (1) the Office of Personnel Management (OPM) issued advisory guidance for federal agencies' LWOP administration; (2) other regulations required federal agencies to grant LWOP to disabled veterans undergoing medical treatment and military reservists or National Guard members involved in military training; and (3) OPM guidance suggested that federal agencies develop LWOP policies balancing government interests and employee needs. GAO also found that: (1) Justice's LWOP policies were similar to OPM guidance, although Justice limited the amount of extended LWOP managers could grant in certain situations; (2) of 120 Justice-approved extended LWOP cases, 105 cases were for less than 181 days, 13 were for 181 days to a year, and 2 were for more than 1 year; and (3) of 32 Justice-approved LWOP cases GAO reviewed, 11 involved health reasons, 10 involved maternity leave, and 11 involved school attendance, temporary nonfederal public or private service, and family member care.
