Agreement Negotiated Between the International Brotherhood of Electrical Workers and the Bureau of Indian Affairs

GAO received a request concerning the applicability of a decision to an agreement between a labor union and the Bureau of Indian Affairs. In addition, a clarification was requested of the applicability of a section of Public Law 92-392 to a 7-percent wage increase negotiated for the employees of the San Carlos Irrigation Project. The wages negotiated by the union had been declared by Department of the Interior officials to be subject to a 5.5-percent pay cap for fiscal year 1979 and a 7-percent pay cap for fiscal year 1980. GAO found that the legal basis for the Interior application of a pay cap to these employees was not cited. One section of Public Law 95-429 did impose a 5.5-percent pay cap on certain federal employees. If the employees on this project do have their wages negotiated under Public Law 92-392, then Public Law 95-429 would appear to have no application to them.
