OCC's Procurement of Laser Printers is Proper but ADP Statutes Apply Gao ID: IMTEC-87-17 April 9, 1987

Pursuant to a congressional request, GAO: (1) reviewed the Office of the Comptroller of the Currency's (OCC) procurement of laser printer equipment to determine whether OCC reasonably weighted technical considerations over cost; and (2) determined whether OCC was subject to the Property and Administrative Services Act and the Competition in Contracting Act.

GAO found that: (1) OCC reasonably determined that, since commercially available equipment would not meet its requirements, it needed to conduct a negotiated procurement to allow for different technical approaches; (2) OCC reasonably evaluated proposals and selected the awardee; and (3) despite OCC contentions to the contrary, it is subject to the requirements of the Property and Administrative Services Act, the Automatic Data Processing Equipment Act, and the Competition in Contracting Act, since it is an executive agency, as defined by those statutes. GAO noted that, despite OCC concerns, it conducted its review pursuant to a congressional request and not in the interest of considering an untimely procurement protest.
