President's Third Special Message for Fiscal Year 1986

GAO reviewed the status of the Urban Mass Transportation Administration's budget authority that was proposed for rescission in the President's third special message for fiscal year 1986.

GAO found that: (1) the Congressional Budget and Impoundment Control Act requires that funds proposed for rescission be made available for obligation unless Congress completes action on the rescission bill within 45 days; (2) although Congress disapproved a previous deferral of the same budget authority, the President provided no new basis to justify the reimpoundment; and (3) since the 45-day period ended before Congress passed a rescission bill, all the funds proposed for rescission were made available for obligation.
