Nitrogen Oxides Emission Reduction Program Gao ID: OGC-97-8 January 3, 1997

Pursuant to a legislative requirement, GAO reviewed the Environmental Protection Agency's (EPA) new rule on the Nitrogen Oxides Emission Reduction Program. GAO found that: (1) the rule would promulgate standards for the second phase of the Nitrogen Oxides Reduction Program under Title IV of the Clean Air Act by establishing nitrogen oxides emission limitations for certain coal-fired electric utility units and revising nitrogen oxides emission limitations for others as specified in section 407(b)(2) of the act; (2) EPA did not comply with applicable requirements in promulgating the rule, since it did not incorporate the required 60-day delay in the rule's effective date; and (3) EPA will publish a corrected notice in the Federal Register which will contain an effective date with the required 60-day delay.
