Comments on Proposed Federal Acquisition Regulation (FAR) Section 15.106

The Office of Federal Procurement Policy of the Office of Management and Budget asked GAO for comments on certain proposed Federal Acquisition Regulations. GAO had no objection to proposed waivers of Government surveillance reviews under certain conditions, nor to requiring the fixed-price contracts clause only for procurements over $100,000, because smaller contracts are less likely to have subcontractors for which consent would be required. A proposal not to prohibit the noncompetitive award of multi-year contracts was criticized, however, for its probable effect of discouraging competition and foreclosing possible sources from competing for such procurements for several years at a time.
